Examining the Fight for Transgender Legal Protections: An Impactful Documentary Unveils the Personal Narrative

Transgender filmmaker Sam Feder's latest feature "Heightened Scrutiny" provides a compelling dual perspective – both an personal portrait of a key trans activist and a pointed examination of media reporting surrounding transgender rights.

Judicial Battle at the Supreme Court

This feature documents ACLU lawyer Chase Strangio as he prepares for oral arguments in the important Supreme Court case US v Skirmetti. This legal battle occurred in December 2024, with the judiciary eventually deciding in support of Tennessee's case, essentially enabling bans on healthcare for transgender minors to stay in place across multiple US territories.

We produced Heightened Scrutiny in only 16 months, explained Feder during a conversation. By contrast, my previous film Disclosure took me half a decade, so this was a real push. Our goal was to stimulate dialogue so people would know more about the case.

Personal Narrative Amid Political Battle

While Feder presents a thorough analysis of how major media outlets have disseminated anti-trans rhetoric, the film's primary accomplishment may be its compelling portrayal of Strangio. Typically a measured lawyer in public settings, Strangio shows his humanity throughout the documentary.

This represented a major challenge, to open up aspects of my life to a camera lens that I had made efforts to keep private, explained Strangio. Sam told me he wanted the next generation to know that we fought, to see what was done in support of these struggles for our basic existence.

Varied Perspectives in the Struggle

To enhance Strangio's story, Feder features various transgender advocates, including well-known figures from media and entertainment. This film also includes insights from non-trans allies who critique how mainstream publications have contributed to damaging reporting of transgender people.

The experience of trans youth central to the legal case is illustrated through a extraordinary 12-year-old girl named Mila. Viewers observe her advocating for her peers at a school board meeting, with later moments showing her protesting for transgender rights outside the Supreme Court.

Personal Moments Beyond the Legal Battle

Heightened Scrutiny also contains touching moments where Feder moves beyond the ongoing political battle, such as sequences of Strangio vacationing in Italy and getting a tattoo featuring words from civil rights leader Pauli Murray's poem "Prediction."

This ink sequence is one of my most cherished sections in the movie, explained Strangio. Getting inked is nearly like a meditative process for me, to be totally engaged in my body and to view it as a vessel for things that are meaningful to me.

Body Identity and Representation

Feder's attention to thoughtfully capturing Strangio adding to his tattoo collection underscores that Heightened Scrutiny is primarily about trans bodies – not just those of young people who experience prohibition of their ability to live truly in their own bodies, but also the bodies of the numerous interviewees who participate in the documentary.

I create films with a meaning, and part of that is selecting people who are outstanding and articulate enough to sustain the camera, explained Feder. Whenever people ask me what they should wear for an filming, my answer is anything that makes you feel hot. That is essential to me – as trans people, we face challenges so much with our image.

Impact and Hope

One factor that causes Feder's documentaries shine is his clear skill for making his trans participants feel at ease, seen and valued. This technique fosters authentic chemistry between Feder and Strangio, enabling the director to achieve his goal of presenting Strangio as a complete person and providing a record for coming generations of how resiliently he and fellow activists have campaigned for transgender rights.

I hope not people to end up in a place of constant discouragement because of what the law is failing to provide us, stated Strangio. I strive to be in a practice of using the law to minimize harm, but not to make it some sort of pathway for our freedom potential. Official institutions is not going to be the mirror through which we see ourselves. Our community are that reflection, and it's very crucial that we continue having that conversation alongside discussions about resisting these regulations and approaches.
